1. Scope and purpose
These Terms of Business are intended to apply where MHAIDAR LAW agrees to provide legal services to a client. They should be provided together with an engagement letter confirming the scope of work, fees, responsible lawyer, client details and specific instructions.
2. Formation of client relationship
MHAIDAR LAW will only act for a client after accepting instructions, completing any required conflict checks and AML/KYC checks, and confirming the engagement in writing.
3. Scope of work
The scope of services will be set out in the engagement letter. Work outside the agreed scope may require a further agreement or additional fees.
4. Client responsibilities
Clients are responsible for providing accurate, complete and timely information, instructions and documents. Clients must promptly inform MHAIDAR LAW of any changes that may affect the matter.
5. Fees and payment
Fees, billing arrangements, retainers, disbursements and payment terms will be set out in the engagement letter or fee agreement. MHAIDAR LAW may request payment on account before commencing or continuing work.
6. Confidentiality
Client information will be treated confidentially subject to legal, regulatory, professional, AML/KYC and court obligations.
7. Data protection
Personal data will be processed in accordance with the Privacy Policy, any Client Privacy Notice and applicable data protection law, including GDPR and Law 125(I)/2018.
8. AML/KYC
MHAIDAR LAW may be required to verify identity, beneficial ownership, source of funds and source of wealth, and to conduct ongoing monitoring under AML legislation. Failure to provide required information may prevent the firm from acting.
9. Conflicts of interest
MHAIDAR LAW may be unable to act where a conflict of interest exists or arises. Conflict checks may be conducted before accepting or continuing instructions.
10. Limitation of liability
Any limitation of liability must be reasonable, lawful and set out in the engagement letter. This clause should be tailored before use.
11. Termination
Either party may terminate the engagement in accordance with the engagement letter, professional rules and applicable law. Outstanding fees and disbursements remain payable.
12. File storage
Files may be stored electronically or physically. Documents may be retained or destroyed in accordance with legal, professional, regulatory and data retention requirements.
13. Governing law
These Terms of Business are governed by the laws of the Republic of Cyprus.
